公产与私产之间——公社解体之际的村队成员权及其制度逻辑

| 摘要： | 20世纪80年代初期,家庭联产承包责任制广泛推行,公社制度逐渐解体,公社时期就埋下种子的财产纠纷,特别是村队与家户之间的房产纠纷大量发生,村队成员权的制度逻辑也得以充分呈现。村落传统的亲族关系、家族共财观念、生存伦理和互惠观念,与包含阶级话语、集体主义公平原则的村队新传统,成为村队场境的内在组成部分,而村队成员权恰恰反映了两者紧密结合的制度逻辑,可以概括为“公”、“私”相对化的实践逻辑。 |
| 英文摘要： | When the people' s communes were broken up gradually in the early eighties of
the 20th century , there were a great of property disputes between peasant households and
village-crews, and the institutional logic of the right of village-crew member were fully
demonstrated. The right of village-crew member is a combined form of village tradition and
new village-crew tradition, which could be considered as a relativity of public and private. |
